BE IT ORDAINED by the City Council that the Quincy Municipal Code is hereby amended as follows:

In Title 5 Business Licenses and Regulations, Chapter 5.08 – Gas Stations is hereby amended as follows:

Chapter 5.08.020 – Self-service filling stations.

Strike the last sentence in the second paragraph, which reads, “No service station licensed under this section shall be allowed to sell any food.”

Strike “seven days’ notice” in the third paragraph and insert in lieu of thereof the following: “fourteen days’ notice”.

Chapter 5.08.030 – Sale of food products — Prohibited — Exceptions.

Strike said 5.08.030 and insert in lieu of thereof the following:

The Board of License Commission (“Board”) may, after a public hearing, issue a permit for a gasoline filling station to engage in the sale of dairy products or other food products. Prior to the issuance of any license under this section the applicant shall provide the Board with proof that all property owners within three hundred feet of the applicant’s property have received at least fourteen days’ notice of said hearing. Any applicant granted a license shall pay in full any and all fees applicable under Chapter 5.40.030 – Common Victualler or Chapter 5.40.050 – Health Department Fees. Whoever violates this section shall pay a fine of fifty dollars for each violation. The “Board” may impose conditions on said license as deemed necessary to provide for the safety of the general public using the gasoline filling station, including the hours of operation and regulations set forth by the Board of Health related to food safety compliance.
