DISCONTINUANCE OF COTTAGE STREET, A PUBLIC WAY
WHEREAS, the City of Quincy (“City”) is a duly organized Municipal Corporation, with its principal offices at Quincy City Hall, 1305 Hancock Street, Quincy, Massachusetts;
WHEREAS, the City, acting in pursuance to its powers and in accordance with its authority as set forth in Chapter 82, Section 21 of the Massachusetts General Laws, Chapter 898 of the Massachusetts Acts of 1973, as amended by Chapter 355 of the Acts of 2016 and as otherwise amended, and every other power thereunto enabling, determined that a certain public way known as Cottage Street, which runs and is laid out from its intersection with Cottage Avenue to its intersection with Revere Road, and as is more particularly described in Exhibit A, attached hereto, shall be discontinued as a public way for the purposes of and in furtherance of the goals and objectives of the Quincy Center District Urban Revitalization Development Plan, and the safety and efficiency of public travel.
NOW, THEREFOFRE, be it ordained that Cottage Street, as laid out and more particularly described in Exhibit A, is hereby discontinued as a public way.
AND FURTHER, be it Ordained that the City Council of the City of Quincy caused this Order of Discontinuance to be recorded in the Norfolk County Registry of Deeds [and filed for registration Norfolk Registry District of the Land Court], together with a Plan of Discontinuance entitled “City of Quincy Public Works Department, Engineering Division, Discontinuance Plan, Cottage Street” dated October 4, 2017, prepared by Feldman Land Surveyors.
A certain parcel of land in the City of Quincy, Norfolk County, Commonwealth of Massachusetts, more particularly bounded and described as follows:
Commencing at a point being the intersection of the southwesterly sideline of Dennis Ryan Parkway and the northwesterly sideline of Revere Road, thence running S22°48’09″W, a distance of 213.55 feet to a point of beginning;
Thence continuing S22°48’09″W, by the sideline of Revere Road, a distance of 40.08 feet to a point;
Thence turning and running N70°51’27″W, a distance of 416.75 feet to a point of non-tangency;
Thence running along a non-tangent curve to the left with a radius of 10.00 feet, an arc length of 5.57 feet, a chord length of 5.50 feet and chord bearing S37°30’22″W to a point on the sideline of Cottage Avenue;
Thence turning and running N21°32’57″E, a distance of 71.33 feet to a point of non-tangency;
Thence running along a curve to the left with a radius of 25.00 feet, an arc length of 40.32 feet, a chord length of 36.09 feet and a chord bearing S24°39’15″E to a point of tangency;
Thence turning and running S70°51’27″E, a distance of 393.06 feet to the point of beginning.
The above described parcel having an area of 16,898 square feet, shown as “Area To Be Discontinued” on a plan tided “City of Quincy Public Works Department, Engineering Division, Discontinuance Plan, Cottage Street” dated October 4, 2017, by Feldman Land Surveyors.
